These terms govern your use of our services and establish clear expectations for both parties. Please review them carefully before proceeding.
Overview
By requesting services from Colorwheel ("Company," "we," "us," or "our"), you ("Client," "you," or "your") agree to these Terms and Conditions. These terms apply to all roofing, water mitigation, emergency services, restoration, and related work performed by Colorwheel.
Estimates & Scheduling
Estimates are provided based on information available at the time of inspection. Final pricing may vary based on unforeseen conditions discovered during work. Scheduling is subject to weather conditions, material availability, and crew capacity. We will communicate any delays promptly.
Client must provide reasonable access to the property, including adequate clearance for equipment, parking for crew vehicles, and access to power and water as needed.
Scope of Services
Our services include residential and commercial roofing installation and repair, water damage mitigation and extraction, emergency response and property stabilization, storm restoration, and general contracting for related projects. The specific scope of work will be outlined in your service agreement or proposal.
Change Orders
Any changes to the agreed scope of work must be documented in writing through a change order. Additional costs or time resulting from change orders will be communicated and approved by the Client before proceeding.
Payments
Payment terms will be specified in your service agreement. Typically, a deposit is required to secure scheduling, with the remaining balance due upon project completion. We accept checks, credit cards, and ACH transfers.
For insurance claims, Client is responsible for deductibles and any amounts not covered by insurance. We can work directly with your insurance provider to streamline the process.
Warranty
Workmanship Warranty: We warrant our workmanship for a period specified in your service agreement (typically 1-5 years depending on the service). This warranty covers defects in installation or execution but does not cover damage caused by improper maintenance, severe weather, or normal wear and tear.
Manufacturer Warranty: Materials and products are covered by their respective manufacturer warranties. We will assist with warranty claims as needed.
Limitation of Liability
To the fullest extent permitted by law, Company's liability for any claims arising from services shall be limited to the amount paid by Client for the specific services at issue. We are not liable for indirect, incidental, consequential, or punitive damages. Nothing in these terms limits our liability for death, personal injury, or fraud.
Indemnification
Client agrees to indemnify and hold Company harmless from any claims, losses, or damages arising from Client's breach of these terms, failure to maintain the property, or interference with the work.
Dispute Resolution
In the event of a dispute, both parties agree to first attempt good-faith negotiation. If unresolved, the dispute may be submitted to binding arbitration in Lafayette, Louisiana, in accordance with the rules of the American Arbitration Association.
Governing Law
These Terms and Conditions are governed by the laws of the State of Louisiana, without regard to its conflict of law principles. Any legal action arising from these terms shall be brought exclusively in the courts of Lafayette Parish, Louisiana.
